Procurement Code

Spanish and Mexican Community Land Grants-Mercedes that are political sub-divisions of the state are required to follow the New Mexico Procurement Code Statutes found in §13-1-1 through §13-1-199 NMSA 1978. The Procurement Code sets out the requirements for how public bodies make purchases of items of tangible personal property (goods), services (including professional services) and construction. The Procurement code allows for several methods of procuring goods, services and construction. Methods allowable are dependent on the various factors including: price; what is being procured; and source of funds being used for procurement.

Types of procurement methods include: small purchases, competitive sealed bids; competitive sealed proposals; competitive sealed qualification based proposals, sole source, emergency procurement; and procurement under existing contracts.
